Envato requires Envato Market authors to confirm whether they are a trader under the EU Digital Services Act (DSA). If an author confirms that they are a trader then Envato is required to verify and display their trader contact information on Envato Market.
What is the DSA?
The DSA is an EU law that protects consumers by increasing transparency and accountability in digital marketplaces. The DSA regulates certain digital marketplaces, such as Envato Market, who provide their services to customers in the EU.
You can find out more details about the DSA on the EU Commission website.
Who qualifies as a Trader under the DSA?
The DSA defines a trader as “any natural person, or any legal person irrespective of whether privately or publicly owned, who is acting, including through any person acting in his or her name or on his or her behalf, for purposes relating to his or her trade, business, craft or profession.”
The European Commission has issued Guidance as to what constitutes a trader (See section 2.2 ‘Concept of Trader’).
You may be considered a trader if you:
- Regularly create and sell digital assets as a business activity
- Operate as a freelancer, agency, or company selling creative assets
- Consider your Envato portfolio as part of your professional income
- Have an established business creating templates, themes, music, video assets, or other digital content
- Have a registered business number (ie: ABN), as a company or as a sole trader
You may not be a trader if you:
- Create and share digital assets only as a hobby or side project
- Sell creative content occasionally as a private individual
- Don't operate as a professional creative business
- Share your work primarily for creative expression rather than business purposes
You must confirm whether you are a trader.
Envato Market authors must assess whether they are a trader for EU law purposes. If you determine that you are a trader, you should select “Yes, I am a trader” under the ‘Trader Status’ section when completing your Author Profile. If you are not a trader, you should select “No, I am not a trader” under the ‘Trader Status’ section when completing your Author Profile. It is your responsibility to determine whether you are a trader. Envato can’t make this determination or advise whether you are a trader. If you are unsure about your trader status, consider seeking legal advice.
If you confirm your trader status by selecting ‘Yes, I am a trader’, Envato must display your contact information on Envato Market, in accordance with EU law. This includes your name, address, email and telephone number. For registered businesses, this will also include certain business registration details. If you are a trader, you are also required to certify that you only offer products or services that comply with the applicable rules of EU law.
