About this policy
1. Hi, we're Envato and welcome to our Acceptable Use Policy. This policy applies to all users of Envato Sites and sets out how you can use Envato Sites and Content and places certain restrictions on the types of Content that can be uploaded and used on Envato Sites.
2. Please take the time to read this policy carefully, and check it regularly as it may be amended from time to time. Your use of the Envato Sites is conditional on your acceptance of this policy.
3. Any terms that are capitalized will have the meanings set out in the Definitions section of this policy. Words like ‘include’ and ‘including’ are not words of limitation.
So what's not acceptable use?
4. It's NOT OKAY to use any Envato Site or Content, or to upload, submit, post, build, create, host or otherwise make available any Content that contains, provides access to (e.g. through links to third party websites) or promotes any of the following Content or activities:
a. Adult content: This includes Content that is sexually explicit or pornographic (such as nudity or sexual activity) or promotes any commercial activity linked to adult content, such as escort agencies.
b. Exploitation of children: This includes Content that seeks to harm or exploit children or depicts children in a way that encourages or promotes attraction towards children.
c. Hate speech and discrimination: This includes Content that supports or condones violence or discrimination against individuals based on race, ethnicity, religion, disability, age, gender, nationality, sexual orientation or gender identity.
d. Incitement of violence: This includes Content that threatens, or that is intended to incite or create violence or a risk of physical or mental harm, against an individual or group of individuals.
e. Harassment: This includes Content that involves any form of harassment, bullying or threatening behavior against an individual or group of individuals.
f. Defamation: This includes Content that contains any untruthful comments about a person that has the tendency to lower their estimation in the eyes of others.
g. Third party rights: This includes Content or the use of an Envato Site in violation of the rights of others, including copyright or other intellectual property rights and data privacy rights.
h. Offensive content: This includes Content that would cause offence to a reasonable person, including Content that is posted for ‘shock value'.
i. Fraudulent, misleading or deceptive conduct: This includes Content containing any information or disinformation that is false, misleading or deceptive.
j. Supply of regulated or illegal goods and services: This includes Content that promotes the supply of weapons or gambling.
k. Illegal activities: This includes Content that violates any applicable law or promotes activities that are illegal.
l. Activities which cause harm to Envato or others: This includes Content which might cause harm to Envato, a Group Company or any other person. For example, pirated software, programs or archives that provide the functionality to gain unauthorised access to other systems or networks of any kind, Warez sites, files or web pages that contain viruses, trojans, malware or other applications designed to access a user's equipment or information with illegal intentions and/or without the knowledge of the user.
m. Use of Content for AI training: The use of Envato Sites or Content to train, develop, or enhance artificial intelligence models or machine learning algorithms, whether directly or indirectly, is prohibited. Any unauthorized use for such purposes will be considered a material breach of this policy and may result in immediate termination of access to Envato’s products and services and/or legal action.
5. We reserve the right to take action under this policy if we see Content that is inconsistent with the spirit of this policy, even if it’s something that is not expressly forbidden. In other words, if you do something that isn’t listed here, but it looks or feels like something listed here, we may still take action.
Community participation
6. Envato is founded on the idea of community and like any functioning and healthy community, some things are not allowed. It’s NOT OKAY to:
a. attempt to gain unauthorised access to computer systems or Content through an Envato Site;
b. attempt to contact other members through an Envato Site or use any information gained from an Envato Site or Content with the intention to make a private arrangement that would otherwise be made using an Envato Site;
c. enter any arrangements that are not consistent with, or are intended to apply in addition to, the specific user terms and rules for using each of the Envato Sites;
d. use information from an Envato Site or Content in a way that may confuse or mislead any third party (for example, gathering information to set up a site that looks like an Envato Site);
e. use or permit the use of any device, program or process to monitor, copy, or scrape all or any part of any Envato Site; and/or
f. attempt to or actually interrupt, negatively impact or alter any Envato Site in any way.
Investigation and reporting
7. To protect our community, we use a combination of automated tools and human moderation to identify, review, and address Content or activities that violate this policy and/or other applicable Envato terms, policies and guidelines.
8. Our Content moderators carefully review any potentially problematic Content flagged by our automated systems, as well as investigate reports we receive regarding unacceptable use. You agree to cooperate with us to investigate and remedy any violation of this policy.
9. Users can report illegal Content via the “Reporting illegal content” form on our website. Reports about other unacceptable use or Content can be made by emailing us at report.abuse@envato.com. All reports will be addressed by our Content moderators. We respond in the same way to any reports made by a government or public authority or law enforcement agency regarding a potential violation, but prioritise reports from those agencies which are classified under the Digital Services Act EU (DSA) as “trusted flaggers”, as required by law.
Enforcement and appeals
10. We reserve the right to determine whether any use of an Envato Site or any Content violates this policy at our sole discretion. Factors we may take into account when determining whether a violation of this policy has occurred, include:
a. the absolute number or amount of unacceptable Content uploaded or unfounded notices or complaints submitted;
b. the relative proportion of the Content or notices that are unacceptable;
c. the gravity of the violation and its consequences;
d. the intention of the recipient, individual, entity or complainant; and
e. any previous violations of this policy.
11. If we believe that your use of an Envato Site or any of your Content or activities are in breach of this policy, we may immediately, without notice or liability and without affecting any other remedies available to us:
a. request that you remove, delete or disable the relevant Content from the Envato Sites;
b. remove, delete or disable the Content, demote or restrict visibility of the Content or impose other measures relating to the Content;
c. suspend or terminate any accounts or agreements you have with Envato and/or your access to any of the Envato Sites, either permanently or temporarily;
d. stop providing you with services, including hosting your website;
e. in serious cases such as those involving the abuse of children, or other illegal activity, make a report to the appropriate authorities; and/or
f. any combination of any of the above actions.
12. The suspension or termination of your access to an Envato Site or your Envato account may result in forfeiture of Content licenses, and associated Content and memberships.
13. We will respond to notices of alleged copyright infringement that comply with the Digital Millennium Copyright Act (DMCA). Information about our policy relating to claims of intellectual property infringement may be found here.
14. The DSA gives European users of Envato Sites the right to challenge moderation decisions made by online platforms. If you don’t agree with a decision that we make under this policy you can submit an appeal within 180 days. You can appeal directly through our website or by lodging or responding to a Helpdesk ticket.
15. If you’re not happy with the outcome of an appeal, you might be able to take things further through an out-of-court settlement or by going to court. The DSA requires EU Member States to approve out-of-court settlement bodies to handle disputes like these. Once certified, these bodies will be listed on a website managed by the European Commission. Decisions made by these out-of-court bodies aren’t binding on you or Envato.

Definitions
Content: any information, content, data, materials, digital goods or items that are uploaded, shared, posted, submitted or otherwise made available on or used in connection with an Envato Site, including but not limited to any text, images, audio, code, video, templates, fonts and other proprietary information.
Envato, we, us or our: Shutterstock, Inc.
Envato Sites: Envato Elements, Envato Market, Placeit, Mixkit, AI Labs, Envato Tuts+, Reshot, Empowerkit and any other Envato platforms or sites which reference this policy, together with their associated websites, products, services, items and Content.
Group Companies: Envato and any company that controls, is controlled by or is under common control with Envato.
