About this policy
- Hi, we're Envato and welcome to our Acceptable Use Policy. This policy applies to all Users of the Envato Sites and sets out what you can and cannot do with the Envato Sites and its Assets.
- Please take the time to read this policy carefully, and check it regularly as it may be amended from time to time. Your use of the Envato Sites is conditional on your acceptance of this policy.
- Any terms that are capitalized will have the meanings set out in the Definitions section of this policy. Words like ‘include’ and ‘including’ are not words of limitation.
So what's not acceptable use?
- It's NOT OKAY to use any Envato Site to upload, submit, post, build, create, host, distribute or otherwise make available any Content, that contains, provides access to (e.g. through links to third party websites) or promotes any of the following types of materials or activities:
a. Adult content: This includes material that is sexually explicit or pornographic (such as nudity or sexual activity) or promotes any commercial activity linked to adult content, such as escort agencies.
b. Exploitation of children: This includes material or activities that seek to harm or exploit children, threatens child safety, age-inappropriate material, or depicts children in a way that encourages or promotes child abuse, or attraction towards children.
c. Hate speech, terrorism and/or discrimination: This includes any form of speech, material or other activity that supports or condones violence or discrimination against individuals based on race, ethnicity, religion, disability, age, gender, nationality, sexual orientation or gender identity.
d. Incitement of harm or violence: This includes any material or activity that threatens, or that is intended to incite, promote or create violence or a risk of physical or mental harm, against an individual (including encouragement of self harm, or eating disorders), a group of individuals or promotes or encourages animal cruelty.
e. Harassment: This includes material or activity that involves any form of harassment, bullying, (including cyber-bullying), or threatening behavior against an individual or group of individuals.
f. Defamation: This includes material that contains any untruthful or defamatory material about a person that would have the likely tendency to lower their estimation in the eyes of others.
g. Infringement or violation of third party rights: Use of an Envato Site or Asset to share, create or distribute material in violation of the rights of others is not permitted, including infringement or likely infringement of intellectual property rights (including copyright and trade marks), location or property rights, or privacy rights (including any unauthorized impersonation of another person).
h. Offensive content: This includes material or activities that would cause offence to a reasonable person, including creating Content that is posted for ‘shock value' or is otherwise obscene, hateful or vulgar.
i. Fraudulent, misleading or deceptive conduct: This includes material or activities containing or involving any statements, information or disinformation that is false, misleading or deceptive.
j. Supply of regulated or illegal goods and services: This includes material or activities that promote the supply of weapons or gambling.
k. Illegal, unethical or criminal activities: This includes material or activities that violates or is likely to violate any applicable law or promotes activities that are illegal, unethical or criminal.
l. Activities which cause harm to Envato or others: This includes material or activities which might cause harm to Envato, a Group Company or any other person. For example, pirated software, programs or archives that provide the functionality to gain unauthorised access to other systems or networks of any kind, Warez sites, files or web pages that contain viruses, trojans, malware or other applications designed to access a user's equipment or information with illegal intentions and/or without the knowledge of the user.
m. Unauthorized activities relating to artificial intelligence: This includes the use of Envato Sites or Assets to train, develop, or enhance artificial intelligence models or machine learning algorithms, whether directly or indirectly. Any unauthorized use for such purposes will be considered a material breach of this policy and may result in immediate termination of access to Envato’s products and services and/or legal action.
n. Unauthorized activities that exploits sensitive subject matter: This includes material, that exploits, trivialises, or sensationalises sensitive or mature subject matter (such as domestic violence, sexual abuse or trauma) or in any other manner described under this section 4.
To avoid doubt, if there are Assets available on an Envato Site that depict or reference sensitive topics, these Assets may only be used in a context where it serves an educational, informational, journalistic, or advocacy purpose. Misuse of an Asset under this section 4(n) may result in account suspension or immediate termination of access to Envato’s products and services and/or legal action.
- We reserve the right to take action under this policy if we identify that your Content includes material or promotes activities that are inconsistent with the spirit of this policy, even if it’s something that is not expressly forbidden under this policy. In other words, if you do something that isn’t listed here, but it looks or feels like something listed here, we may still take action.
Community participation
- Envato is founded on the idea of community and like any functioning and healthy community, some things are not allowed. It’s NOT OKAY to:
a. attempt to gain unauthorised access to computer systems, Assets through an Envato Site;
b. attempt to contact other members through an Envato Site or use any information gained from an Envato Site or an Asset with the intention to make a private arrangement that would otherwise be made using an Envato Site;
c. enter any arrangements that are not consistent with, or are intended to apply in addition to, the specific user terms and rules for using each of the Envato Sites or any Asset;
d. use information from an Envato Site or an Asset in a way that may confuse or mislead any third party (for example, gathering information to set up a site that looks like an Envato Site);
e. use or permit the use of any device, program or process to monitor, copy, or scrape all or any part of any Envato Site or Assets; and/or
f. attempt to or actually interrupt, negatively impact or alter any Envato Site in any way.
Investigation and reporting
- To protect our community, we use a combination of automated tools and human moderation to identify, review, and address Assets, Content or other User materials that violate this policy and/or other applicable Envato terms, policies and guidelines.
- Our content moderators carefully review any potentially problematic Content or other User materials that are flagged by our automated systems, as well as investigate reports we receive regarding unacceptable use. You agree to cooperate with us to investigate and remedy any violation of this policy.
- Users can report illegal Content via the “Reporting illegal content” form on our website. Reports about other unacceptable use, Assets,Content or other User materials can be made by emailing us at report.abuse@envato.com. All reports will be addressed by our content moderators. We respond in the same way to any reports made by a government or public authority or law enforcement agency regarding a potential violation, but prioritise reports from those agencies which are classified under the Digital Services Act EU (DSA) as “trusted flaggers”, as required by law.
Enforcement and appeals

We reserve the right to determine whether any use of an Envato Site, or use or creation of an Asset or any Content violates this policy at our sole discretion. Factors we may take into account when determining whether a violation of this policy has occurred, include:
a. the absolute number or amount of unacceptable Assets, Content or other User materials uploaded or unfounded notices or complaints submitted;
b. the relative proportion of the Asset, Content or other User materials or notices that are unacceptable;
c. the gravity of the violation and its consequences;
d. the intention of the recipient, individual, entity or complainant; and
e. any previous violations of this policy.

If we believe that your use of an Envato Site, or use or creation of any Assets, or any of your materials, Content or activities are in breach of this policy, we may immediately, without notice or liability and without affecting any other remedies available to us:
a. request that you remove, delete or disable the relevant Asset or other Content from the Envato Sites;
b. remove, delete or disable the Assets or other Content, demote or restrict visibility of the Asset or Content or impose other measures relating to that Asset or other Content;
c. suspend or terminate any accounts or agreements you have with Envato and/or your access to any of the Envato Sites, either permanently or temporarily;
d. stop providing you with services, including hosting your website;
e. in serious cases such as those involving the abuse of children, or other illegal activity, make a report to the appropriate authorities; and/or
f. any combination of any of the above actions.
- The suspension or termination of your access to an Envato Site or your Envato account may result in forfeiture of any licenses to Assets and other Content granted under the applicable Envato license terms, and termination of applicable memberships.
- We will respond to notices of alleged copyright infringement that comply with the Digital Millennium Copyright Act (DMCA). Information about our policy relating to claims of intellectual property infringement may be found here.
- The DSA gives European users of Envato Sites the right to challenge moderation decisions made by online platforms. If you don’t agree with a decision that we make under this policy you can submit an appeal within 180 days. You can appeal directly through our website or by lodging or responding to a Helpdesk ticket.
- If you’re not happy with the outcome of an appeal, you might be able to take things further through an out-of-court settlement or by going to court. The DSA requires EU Member States to approve out-of-court settlement bodies to handle disputes like these. Once certified, these bodies will be listed on a website managed by the European Commission. Decisions made by these out-of-court bodies aren’t binding on you or Envato.

Definitions
Assets: digital goods made available for license to a User of an Envato Site, including Items created by Authors on Envato Elements and Envato Market (which includes but is not limited to any text, images, audio, code, video, templates, fonts and other proprietary materials), creative templates on Placeit, and AI-generated content created using any tool available on any Envato Site.
Author: a Member who creates and uploads Items to an Envato Site for licensing by Subscribers.
Content: any information, prompt, post, data or other materials and content from a User of an Envato Site, that is:
(a) built, created, uploaded, shared, or submitted to, or made available in connection with an Envato Site (including any Items provided by an Author, or User uploaded materials including prompts, or other text, images and other materials); or
(b) part of an End Product (whether as part of the Asset, or another component).
End Product: the final work or product that is created that incorporates an Asset together with other components, so that it is larger in scope and different in nature than the original Asset.

Envato Sites: Envato Elements, Envato Market, Placeit, Mixkit, Envato Labs, Envato Tuts+, Reshot, Empowerkit and any other Envato platforms or sites which reference this policy, together with their associated websites, tools, products, services, Assets and other materials and content.
Group Companies: Envato and any company that controls, is controlled by or is under common control with Envato.
Items: digital goods created by Authors and made available on Envato Elements and/or Envato Market, which may include goods like graphic design templates, fonts, WordPress themes, background music, After Effects project files and stock videos, graphics and photographs.
Member: any User who creates and maintains an account with Envato and one of the Envato Sites, whether or not they are an Author or Subscriber.
Subscriber: a Member who purchases a subscription to an Envato Site.
User, you or your: each person who accesses or uses an Envato Site, whether or not they are an Author, Member or Subscriber.
