Introduction
These guidelines set out rules around using content generated with third-party artificial intelligence tools such as DALL-E, Stable Diffusion and Midjourney.
The new field of AI-generated content poses some questions around legal rights and risks. This policy is aimed at achieving the fairest and safest result for both the author community and our customers.
Keep in mind that there are different rules for assets used in item previews (these assets are for preview purposes only, and don’t get distributed to your customers) and assets in the item download (refers to assets that are actually included in the download files).
Using AI-generated content
Yes, go for it:
AI-generated content can be used for preview purposes only, and must not be included in the download file.
Please note that just as with any other assets used within your item preview, it remains your responsibility to ensure that you have the correct commercial license to use the asset within the item preview. For more information please see What assets can I use in my items?
- As an example, you can use AI tools to generate an illustration and use it as a preview image in your blog template, provided the AI license allows you to do this. The image cannot be included in the download file.
- If your item includes a demo content import, AI-generated content can be imported directly from your server, as long as it is not included in the item zip file .
Not allowed:
Authors are currently not allowed to sell AI-generated content as is, or as a standalone item.
This is due to the legal concerns around AI-generated content. As per our Author Terms & Contributor Agreement, you are required to have the right necessary license items, and be able to warrant that the buyer's use of them does not infringe on the rights of others. As AI-generation models may be based on the intellectual property of many creators, this type of content does not meet our requirements.
What does that mean? This means that you cannot sell AI-generated content as the main component of your item. This extends to all content types, across Market and Elements.
- As an example, you cannot use AI tools to generate an illustration, and submit it to the Illustration category on GraphicRiver or Elements.
March 2024 update: We are beginning to test customer demand for AI-generated Stock Video, using a small batch of Envato-created content. During this initial stage, our restrictions on Authors submitting AI-generated content will remain.
